Process Of Collective Bargaining Agreement

[15] The Railway Labor Act (1926) required employers to negotiate collective agreements with unions. When employees of an organization vote for the union organization, the collective bargaining process begins. Collective bargainingThe process of negotiating an agreement between management and staff. is the negotiation process between the company and the union representatives. The aim is for management and the union to reach a contractual agreement that will be concluded for a specified period. Once this period is over, a new treaty will be negotiated. In this section, we will discuss the elements of the collective agreement. From the preparation to the ratification of the agreement, a lot of preparation is taken into account in the collective bargaining process. Some companies and trade unions begin their preparations well in front of the actual bargaining meeting.

Such preparation involves collecting data on the presentation of their own page, anticipating the nature of the questions asked by their opponents, examining previous meetings in previous treaties, the nature of the rebuttals to be given, statistical support, economic data and assessment of the political climate, etc. Answer: Collective bargaining is a voluntary process and must be conducted freely and in good faith. It may cover all conditions of work and employment and regulate relations between employers and employees, as well as between employers` and trade union organisations. It is up to the social partners to decide what will be covered by their negotiations. Among the topics of collective bargaining identified by the ILO Committee on Freedom of Association are: wages, benefits and allowances, working time, annual leave, selection criteria in the event of dismissal, scope of collective agreements and granting of trade union bodies. Collective bargaining is the process in which workers negotiate, through their unions, contracts with their employers to define their terms and conditions of employment, including remuneration, social benefits, working time, leave, workplace health and safety policies, ways to reconcile work and family life and more. Collective bargaining is a way to solve problems in the workplace. It is also the best way to raise wages in America. Indeed, union workers have higher wages, better social benefits and more secure jobs through collective bargaining.

Although the following general steps are listed in the negotiation process, they are subject to certain changes that are not too radical. The inclusion of these changes, whether in the organization of seats or the agenda, calendars may come from the experience gained so far in the negotiations. Therefore, collective bargaining is a political activity carried out by professional negotiators, which clearly distinguishes them from individual negotiations….
